1. Policy. Sales Animals,
L.L.C.’s (“Sales Animals”) policy is to respect and
protect the privacy of the users of SalesAnimals.com (“Sales
Animals Web Site” or “Web Site”).
This Privacy
Policy applies solely to the information that Sales Animals
collects through the Web Site and does not apply to
information Sales Animals collects in any other fashion.
This policy does not apply to the practices of companies
that Sales Animals does not own or control, or to
individuals that are not under Sales Animals’ supervisory
control.
2.
Collection and Retention of Information. Sales Animals
may collect personal or personally identifiable information
including your name, address, e-mail address, telephone
number, credit card number, contact information, billing
information or any other information from which your
identity is discernible when you are on the Sales Animals
Web Site and when you use Sales Animals’ services (“Your
Information”).
a. Users. Sales Animals collects
information about use of the Web Site, such as the pages
users visit most frequently, the services users access the
most, and the links to other sites that users most often
visit. Sales Animals may also log your IP address, domain
name, referring Web site addresses, access times and browser
type when you use the Web Site. Sales Animals only uses
such data in the aggregate (“Aggregate Data”).
b. Registered Users.
i.
Registered Candidates. Job applicants seeking employment
may register with the Sales Animals Web Site (“Registered
Candidates”). During registration, candidates will be asked
for their name, e-mail address, mailing address and have the
opportunity to select a password. In addition, Registered
Candidates may create a candidate profile (“Candidate
Profile”) that provides employers with information about
their qualifications and employment preferences. Candidates
who choose to create a Candidate Profile will be asked for
their name, e-mail address, password and mailing address.
Additionally, Candidates have the option of providing
information about their current job, years of experience,
telephone number(s) as well as posting their resume and/or
posting an image. Candidates may also specify contact
instructions for potential employers. Candidates may choose
whether or not they would like to limit viewer access to
their Candidate Profile to Web Site members (“Members
Only”). Candidate Profiles that are not limited to Members
Only, may be viewed by all Web Site users. Candidate
Profiles that are limited to Members Only, may be viewed
only by Registered Candidates and Registered Employers
(defined hereinafter). While Sales Animals intends members
to comprise paying employers, recruiters, hiring managers,
headhunters, and human resource professionals, as well as
law enforcement and national security agencies, it cannot
guarantee that other parties will not gain access to this
database nor does it confirm, verify or investigate in any
way the accuracy of the information provided by such
members. Employers, recruiters and others who have paid for
access to the Candidate Profile database or to obtain a copy
of that database, as well as parties who have otherwise
gained access to the database, may retain a copy of your
Candidate Profiles in their
own files or databases. Sales Animals is not responsible
for the retention, use or privacy of
Candidate Profiles in these instances.
ii.
Registered Employers. Employers seeking job applicants may
register with the Web Site (“Registered Employers”). To
register, employers must enter their name, e-mail address,
mailing address and select a password. Employers also have
the option of entering additional information such as their
title, company name, telephone number and fax number.
Employers may also post job openings to be viewed by Web
Site users. Employers must submit payment information
including, but not limited to, credit card information and
other billing information.
c.
Cookies. The Web Site uses
cookies to optimize service for visitors. A cookie is a text
file that is placed on your hard drive by a Web page
server. You may have the ability to accept or
decline cookies. Most Web browsers automatically accept
cookies, but you can usually modify your browser setting to
decline all cookies if you prefer. Alternatively, you may
be able to modify your browser setting to notify you each
time a cookie is tendered and permit you to accept or
decline cookies on an individual basis. If you choose to
decline cookies, however, that may hinder performance and
negatively impact your experience on the Web Site.
To make your
repeat use with us more efficient, practical, and relevant,
Sales Animals may retain all the information it gathers
about you indefinitely. Registered Candidates may designate
their Candidate Profile as “inactive” at any time, in which
event the Sales Animals will deactivate the Registered
Candidate’s account. Once deactivated, the Candidate
Profile may not be viewed by other Web Site users, however
Sales Animals maintains an archival copy not accessible via
the Web Site.
3. Use of
Information.
a.
Sales Animals Internal Use.
Sales Animals uses the information it gathers on the Web
Site for the purpose of operating and improving the Web
Site, fostering a positive user experience, and delivering
the products and services that it offers. Sales
Animals may also use the information it gathers to inform
you of other products or services available from
Sales Animals or its
"affiliated companies" or to contact you about your opinion
of current products and services or potential new products
and services or job listings that may be offered.
"Affiliated Companies" means entities that control, are
controlled by or are under common control with
Sales Animals.
b.
Sharing and Disclosure of Information to Others.
i.
Aggregate Data. Sales Animals may disclose the anonymous
Aggregate Data it collects to third parties. This
information helps determine what is most beneficial for our
users, and how Sales Animals can continually improve the
services and features provided to the users of the Web
Site.
ii.
Your Information. Sales Animals may disclose your “Your
Information” to companies and individuals employed by Sales
Animals to perform functions on its behalf including, but
not limited to, providing customer service, processing
credit card payments, analyzing data and hosting our web
servers. Sales Animals will share your “Your Information”
with other entities should you request Sales Animals to
share such information, or if Sales Animals is required to
by court orders, subpoenas or other legal process. Sales
Animals may disclose your “Your Information” it believes in
good faith such action is necessary to protect the rights or
property of Sales Animals or protect the personal safety of
users or the public. In addition, Sales Animals may
disclose any informational content you post, upload or
transmit to the Web Site, if such disclosure is necessary to
enforce the Terms of Use Agreement, to respond to claims of
intellectual property infringement, to comply with legal
process, or to protect the rights of Sales Animals, the
public or other users.
Sales Animals
may disclose and transfer “Your Information” to a third
party who acquires all or a substantial portion of Sales
Animals' business, whether such acquisition is by way of
merger, consolidation or purchase of all or a substantial
portion of our assets. In addition, in the event Sales
Animals becomes the subject of a bankruptcy proceeding,
whether voluntary or involuntary, Sales Animals or its
trustee in bankruptcy may sell, license or otherwise dispose
of “Your Information” in a transaction approved by the
bankruptcy court.
c.
Cookies. Sales Animals uses cookies to tell the Web
server that you have returned to a specific page. For
example, if you register for services or create a Candidate
Profile, a cookie helps us to recall your specific
information (such as user name, password and preferences).
4. Access.
You have the ability to edit your information at any time,
and may deactivate your account at your convenience.
5. Security.
Sales Animals has implemented measures to secure your “Your
Information” from accidental loss and unauthorized access,
use, disclosure or alteration. Sales Animals cannot
guarantee that unauthorized third parties will never defeat
these security measures or use your “Your Information” for
improper purposes. The Candidate Profiles and job listings
must be accessed with passwords. You are advised not to
share your password with any other person.
6. Links.
This Web Site contains links to other sites over which Sales
Animals has no control. Sales Animals is not responsible
for the privacy practices, the content or the practices of
such other Web sites to which you choose to link from the
Sales Animals Web Site. Sales Animals encourages you to
review the privacy policies of those other Web sites so you
can understand how they collect, use and share your
information.
7. Children.
The Sales Animals Web Site is not intended for children
under 13 years of age. The Web Site does not knowingly
collect personal information from children under 13.
8.
Amendments. Sales Animals reserves the right to amend
this policy at any time. Sales Animals shall post a notice
of changes on the Web Site 30 days prior to any change, when
and if the terms of this policy are amended.
9. Your
Consent. By using the Sales Animals Web Site, you
consent to the collection, storage, and dissemination of
personal information as described above. Sales Animals
reserves the right to make any and all changes to this
privacy policy including, but not limited to, its
collection, retention and use of information. Sales Animals
will post any changes to our privacy policy on this page so
that you can readily review the most current policy. As the
policy may change from time to time, you should check back
periodically.
